Muck Munchers Terms & Conditions
By placing an order with Bio-Gard Limited trading as Muck Munchers and / or participating in a Survey or Prize Draw you accept these Terms and Conditions.
1.1 Information supplied by you will only be held and used to conduct business with you and to improve our level of service.
1.2 When you order, we need to know your name, email address, invoice and delivery addresses, and, also payment details including credit or debit card number details, together with other information as may be appropriate. This enables us to process and fulfil your orders and to notify you in the event of any queries. We also request your telephone number which allows us to contact you if there is a problem with your order such as a courier having difficulty making a delivery.
1.3 We will occasionally send you emails relating to your order, such as order confirmations and other important information where you will have given us your consent as part of the registration process.
1.4 We will not sell or rent your email address or telephone number(s) without your permission. We may ask you for some additional information from to time to time to help us improve our service to you - this is entirely voluntary and will be clearly highlighted as such.
1.5 If you wish to have your name and address suppressed from receiving future mailings and emails all you need to do is contact us and all further promotional contacts with you will cease as appropriate.
2. Your Security
2.1 We have security measures in place to protect against loss, misuse and alteration of information under our control. Transaction systems use encryption technology to ensure secure internet and payment transactions.
2.3 We also have security procedures in place to protect confidentiality, integrity and availability of user information.
3. Bio-Gard Prices and Availability
3.1 Prices quoted are in British pounds (£) and are accurate at the time published but may be subject to change. UK VAT where appropriate is included at the current rate.
3.2 If a price increases between you placing and our accepting your order, generally we will honour the original price.
3.3 Products and services are subject to availability and may be withdrawn at any time, including after you have placed your order. If your order cannot be fulfilled we will let you know at the earliest convenient opportunity, refunding the payment made for the goods or offering you a similar alternative product.
3.4 Promotional and money-off vouchers, coupons and schemes can not be used in conjunction with another similar scheme, have no cash value and may require you to redeem them by a specific date to be valid.
4. Our Purchase Agreement
4.1 Contracts of sale will be made with Bio-Gard Limited (registered in England reference 08662158), whose registered office is Glebe Barn, Ringstead, Norfolk, PE36 5JZ.
4.2 When you place an order to purchase goods from us it constitutes an offer. We accept your offers when we send you an order confirmation by post or email, or, advice notes confirming that we have despatched some or all of the goods you ordered. Acknowledgements of receipt of internet orders do not constitute our acceptance. In addition, until payment is received in full or confirmation that a credit or debit card has been pre-approved and notified to us by the issuer acceptance shall be deemed not to have taken place. In the event that there has been an error or omission in the price advertised, we reserve the right to rescind any contract or part of a contract prior to despatch or delivery.
4.3 Any term sought to be imposed by you in your order or during the offer process shall not form part of any contract.
4.4 If we are unable to deliver a product to you we shall advise you as promptly as possible and credit your account with the full value of the item(s) and in addition credit you with any excess postage and packaging contribution that you may have made.
5. Your Guarantee
5.1 All Bio-Gard products are manufactured to the highest standards. If anything you receive from us is faulty or damaged we will replace it free of charge or fully refund the cost, reimbursing the return postage if we have requested it to be sent back to us. In the event that you are not entirely satisfied with anything, you may still return the remaining product within 30 days for a full refund, although in the case where a product has been part-used, return postage costs are not normally reimbursed. Before returning a product please contact us so that we may advise the appropriate action to be taken and confirm the return address details and process.
5.2 This Guarantee is in addition to your statutory rights.
6. Your Payments
6.1 Payment is accepted by cheque and postal order (mail order only), credit and debit card.
6.2 Credit and debit card payments for the full amount of your purchases are collected at the time of ordering. Should any items subsequently not be available we will credit your account.
7. Ownership and Refunds
7.1 Ownership, title and risk of goods pass to you immediately upon despatch of your goods and shall take place at the despatch address.
7.2 Where our delivery agent fails to deliver the goods to your requested UK delivery address, we shall deliver a replacement at our expense.
8. Shipping, Handling and VAT for Your Order
8.1 Irrespective of the number of shipments we may make to you, only one charge for arranging despatch will be made.
8.2 Shipping Charges shown on this website apply to UK and EU Only. For shipment to non-EU countries further charges may apply.
8.3 All prices shown include VAT where applicable.
8.4 Where a simple discount is applied to an order, rather than a specific discount applied to a product, prior to forming a contract, the discount shall be assumed to be applied proportionately across all the products ordered.
9. Our Liability to You
9.1 We shall not be liable for any loss caused or consequential and/or subsequent loss, exceeding the price paid for any item as a result of any dispute. Where there is a partial loss, we reserve the right only to make a proportional replacement, credit or refund.
9.2 This site should only be used for information purposes. We shall not be liable for any damage or loss that may occur in the use of any of the information contained or advice given in this site except as stated in these terms and conditions and to the extent that such liability cannot be excluded by law. We are not responsible for the site’s accuracy, although every effort has, is and will be made to ensure that the information contained is correct and up to date, nor for its fitness for a particular purpose or the reliability of access to this site.
9.3 We will not be liable for damage or losses resulting from your use of or inability to use this site. We do not guarantee that the site will operate free of error or free from computer viruses or other contaminating computer programmes.
9.4 We will not be liable to you or in breach of contract for delay or failure to perform due to any causes beyond the reasonable control of us or our suppliers, including but not limited to Acts of God, civil commotion, industrial dispute, riots, flood and legislation.
10. Use of this Site
10.1 You may view or print individual pages from this site for your own personal use but you may not copy, reproduce, modify, distribute, republish, re-sell, display, post or transmit any part of this site without our written permission, other than to share information on a limited basis for the benefit of Bio-Gard Limited.
11. BioGard Monthly Prize Draw
11.1 This prize draw is open to UK and Irish residents, excluding employees and their immediate families of the Promoter (Bio-Gard Limited), its agents or anyone else connected to the promotion.
11.2 No purchase is necessary to entry the draw.
11.3 Applicants must be 18 years old and over and reside at a property, or own, or rent a 11.4 To enter, participants must provide a valid ‘Order Code’ when ordering any Muck Munchers product or write to the Bio-Gard Monthly Prize Draw, at the address given on the Contacts page, providing an email reply address and affixing stamps to the envelope to the full value for delivery.
11.5 The Monthly Prize Draw commences on 1st August 2016 and will close each month at midnight on the last day of the month and will continue each month until withdrawn.
11.6 Only one entry per person / household will be accepted per month.
11.7 The prize winner will be drawn at random from all entries under and will be notified by email. Details of draw winners from time to time in Bio-Gard Newsletters.
11.8. The monthly prize on offer is a £100 Marks and Spencer Gift Voucher.
11.9 If the prize winner cannot be contacted or does not respond within 28 days, the promoter reserves the right at its absolute discretion to withdraw any prize entitlement and award the prize to another customer or charity.
11.10 No correspondence in connection to the outcome of this draw will be entered into.
11.11 The prize winners may be required to take part in any publicity resulting from this promotion.
11.12 By entering the promotion entrants confirm that they have read and agree to be bound by these terms & conditions, to receive important email confirmations, communications and mailings and also to be bound by the decisions of the Promoter, which are final in all matters relating to the promotion.
11.13 The Promoter and / or its agencies will not be responsible for the non-inclusion of entries as a result any failure on their part. Proof of submission of entry is not proof of receipt of entry.
11.14 The Promoter reserves the right at its sole discretion to disqualify any person it finds to be tampering or to have tampered with the operation of the promotion or to be acting in violation of these terms and conditions.
11.15 The Promoter may, during the course of the Prize Draw, add further prizes and vary the conditions for entry. Any such variation will not affect the validity of any entry already received for a draw.
12. Changes to Bio-Gard Terms and Conditions
12.1 We reserve the right at any time to remove, modify or change without notice any information contained in our printed matter, advertisements or on this site. We may change these terms at any time by posting changes on the site. If you use the site after any changes have been made you will be bound by the new terms.
13. Governing Law and Jurisdiction
13.1 These terms and also your use of this site are governed by and construed in accordance with the laws of England and any disputes will be decided only by the Courts England. E&OE
